Terms of sale. Through the link https://brplegno.com one can access the only official Italian online B.R.P. Legno Shop, where one can purchase the products marketed there and receive them in the areas indicated on the site by the supplier.

The system, which presupposes active intervention on the part of the Customer, has been implemented in full compliance with the regulations on distance selling and in particular with Articles 50 et seq. of the Consumer Code (Legislative Decree No. 206 of September 6, 2005, as amended and supplemented). The use of the distance selling process described in these general conditions of sale is reserved exclusively for consumers as defined in Art. 3 of Legislative Decree. 206 of September 6, 2005 and only if they are residents of the Italian territory (hereinafter referred to for brevity as the “Customer” or the “Customers”).

  1. Scope of application

These terms and conditions apply to all product sales concluded at a distance through https://brplegno.com. These general terms and conditions of distance selling must be carefully reviewed by the Customer before the completion of the distance purchase procedure of the above product.

It is understood that the placing of the purchase order through the site https://brplegno.com, implies total and absolute knowledge of these general conditions of sale and their full acceptance: the Customer, by placing the purchase order through the site https://brplegno.com , unconditionally accepts and undertakes to observe, in his dealings with Giuseppe Scalia – B.R.P. , these general conditions of sale, as well as the conditions of payment set out below, declaring that he has read and accepted all the information provided to him, and also acknowledges that Giuseppe Scalia – B.R.P. does not consider itself bound by conditions other than these, unless previously agreed in writing. These general terms and conditions are to be considered applicable and in force as long as they appear on the website https://brplegno.com.

Should https://brplegno.com change the general conditions of sale in question, this information will be posted on the site and the new general conditions of sale will apply exclusively to orders placed with Giuseppe Scalia – B.R.P.

Information on products susceptible to distance selling through https://brplegno.com is provided in accordance with applicable laws and, in particular, Articles 52 and 53 of the Consumer Code.

  1. Product order

The order can be placed through the website https://brplegno.com, by selecting any product image presented therein and otherwise following the steps and instructions specified on the website. The amount of a single order may not exceed the sum of €10,000 in total. At the successful completion of the payment process by the Customer, Giuseppe Scalia – B.R.P. will give immediate notice of the acceptance of the order, reserving the right to communicate within the next 10 days the possible inability to process the order itself, which will be followed by the immediate cancellation of the order and the simultaneous release of the amount reserved for payment, due to the supervening exhaustion of goods, in case insufficient guarantees of solvency are detected, if the order does not correspond to normal consumption needs (a requirement that applies both in relation to the number of products purchased in a single order and in the case of a plurality of orders for the same product, even if each order includes a quantity of products corresponding to normal consumption needs.), or due to force majeure.

  1. Product price

The price of the product published on the website is for the single piece and/or the pallet (70 bags), expressed in Euros and including VAT.

Giuseppe Scalia – B.R.P. will take care of the payment of all fees, taxes and charges. In accordance with the provisions of Art. 53 of the Consumer Code, the Customer receives upon acceptance of his order, pursuant to Art. 4) above, the written confirmation containing information about the products ordered, the amount paid, details of the price of each product, as well as the existence of the right of withdrawal, the time and method for returning the goods, the geographical address of the headquarters of Giuseppe Scalia – B.R.P. and information on support services and any existing commercial guarantees.

  1. Terms of payment

Payment by the Customer can only be made by credit card, active PayPal account or bank transfer. The following credit cards are accepted: Visa/Visa Electron, Mastercard and PostePay. The total amount of the order is committed to the Customer’s credit card or PayPal account at the time the order is placed with Giuseppe Scalia – B.R.P. (when the Customer selects “Buy Now”), with simultaneous acceptance by Giuseppe Scalia – B.R.P. , pursuant to Art. 4, and activation of product preparation for shipment. In order to prevent Internet fraud, payment made through https://brplegno.com. is managed online by the bank that manages the Customer’s credit card, through the tools offered by Cybersource and PayPal. Cybersource, PayPal and their respective subsidiary companies are responsible for storing and automatically processing in a secure environment information about each order, including details of the credit card used.

For the purpose of payment, the Client must:

  1. Delivery

Delivery of products is made to the address indicated by the Customer, only after regular payment of the order forwarded to Giuseppe Scalia – B.R.P.

The Customer does not have the option of requesting delivery of products to post office boxes and/or the like. In compliance with the provision contained in Art. 54 of the Consumer Code, Giuseppe Scalia – B.R.P. will still make delivery of the products no later than 30 days from the day on which the Customer transmitted the order. In the case of unavailability of the consignee, or other person authorized to receive the shipment at the time of the delivery attempt, you will be contacted again to arrange another delivery day, delivery costs will be borne by the customer. Kind customers are informed to respect the delivery day set by the company to avoid unpleasant delays. We also remind you that on the day of delivery you will be contacted by the courier to inform you of the estimated time of delivery.

  1. Shipping costs

Delivery is free for a radius of 50 to 100 km from our location and may vary depending on the delivery period.

  1. Returns

By following the procedure outlined in the “Returns and Refunds” section of the FAQ, an item purchased on the site https://brplegno.com can always be returned provided that the product is in perfect condition and in the same state in which it was received (see Section 9.2 below), and that the relevant return period has not yet elapsed (see Section 9.3). Upon completion of the above procedure, the Customer will receive an e-mail that the return has been accepted. From receipt of the confirmation e-mail, the Customer has an additional 14 days to deliver the return to the courier or postal service of his or her choice. Return shipping costs will always be borne by the customer. We always recommend keeping the original packaging, which is essential for later acceptance of the return by the store’s quality control.

As a reminder, we can only refund products returned in a condition that meets bag integrity standards (see Section 9.2 below). Our operators will then carry out the necessary quality checks on the returned items in the working days following the date of delivery of the return to our premises, following which the Customer will receive an e-mail confirming the outcome. This will be followed by the immediate arrangement to credit the amount due for all bags received in compliant condition. If one or more items do not meet the checks, this will be immediately communicated to the Customer and the equivalent value will not be refunded. Giuseppe Scalia – B.R.P. will hold the bags judged to be non-compliant, and the Customer may at any time arrange for their removal at its own expense. If you have any questions, you should contact our Customer Service Department.

  • Mode of return

Items can be returned via any carrier, at the discretion of the Customer, who will be responsible for shipping costs. Once it is determined that the products the Customer intends to return are in the same condition as they were when received (see section9.2 below), simply fill out the form on the contact page https://brplegno.com/pages/contact by putting as a message, “I would like to be contacted about a merchandise return request” to request return authorization. If the Customer’s request complies with the bag return period, he/she will receive a return authorization e-mail in a short time. From this time, you will have 14 days to deliver the return to the courier company. If the Customer encounters problems in finding a carrier, he/she is requested to get in touch with the company that will take care recovery of the return, again at the Customer’s expense.

  • Conditions of integrity for return

Giuseppe Scalia – B.R.P. is committed to providing a consistently satisfying shopping experience. However, we know that sometimes the Customer may need to return purchased items. You can return an item purchased at https://brplegno.com only if it is in the same condition in which it was received. This is followed by the checks to be carried out to ensure that the condition of the product’s integrity is such that it can be returned.

The Client must ensure that:

– the item was not damaged during the test;

– the article has not caught rain or moisture;

– the item has been stored in a cool, dry place;

– the article has not been modified in any way;

-The item must be returned undamaged, except for bags that have already been used.

  • Return period

To return an item purchased on https://brplegno.com it is necessary to make the return request no later than 14 calendar days from the day the item was received, and deliver the shipment to a courier within the next 14 days, according to the method proposed in the return arrangements.

  • Refund

When an item is returned, operators must first ascertain that it has not been used or damaged (in this regard, we encourage you to read the conditions of integrity of the returned product in Section 9.2). The Customer will then receive an e-mail confirming the successful completion of the return, which will indicate the beginning of the period regulated by the legal terms within which the amount corresponding to the returned bags will be credited through the payment method selected during the order process.

In the event that the amount refunded is incorrect, the Customer should contact Customer Service for prompt resolution.

  • Items not ordered, damaged, or not in accordance with the order

If the Customer receives a damaged item, or one that he or she had not ordered, he or she may request its immediate return. The return shipping costs will be borne by us. If there is any evidence that the product has been damaged in transit, please notify the Customer immediately to the carrier by having it written on the delivery note.

If the Customer does not comply with this condition, Giuseppe Scalia – B.R.P. will not credit the amount paid, nor will it replace the product. Giuseppe Scalia – B.R.P., in this case, will communicate by e-mail the rejection of the return.

  1. Right of withdrawal and return of products

The Customer may exercise the right of withdrawal provided for in Article 64 of the Consumer Code. It is in the interest of Giuseppe Scalia – B.R.P. that the Customer can exercise this right of withdrawal under the best possible conditions. The Customer may exercise the right of withdrawal within the 14 (fourteen) calendar days following the date of delivery of the order, as certified by the shipper and indicated through the methods presented on the website https://brplegno.com, where the conditions and actions necessary for the exercise of this right, the timing, manner and possible costs of the return operation are also set out. The Customer may then, no later than 14 (fourteen) calendar days after the above request for withdrawal, return the products in the same condition in which they were at the time of their delivery, according to the discipline presented on the website https://brplegno.com under the section “Conditions of Integrity”. The return shall be considered completed when the returned items have been delivered to the courier chosen by the customer, with shipment addressed to the address Località Borgonuovo 38Bra 12042 (CN) indicated in the return authorization confirmation e-mail.

In the event that the exercise of the right of withdrawal meets the above conditions, the refund of the value of the returned products, equivalent to their purchase price deducting the used bags and the cost of transportation (if carried out by our courier) only and exclusively for res , will be made by crediting the amount paid by the Customer within 14 (fourteen) calendar days, starting from the date on which Giuseppe Scalia – B.R.P. became aware of the request for withdrawal and in any case within 10 (ten) working days from the return of the goods.

The Customer who has used one of the return procedures for the ordered products is entitled to a full refund of the price paid, requesting that the amount be credited to his credit card, with which he made the payment. It is understood in any case that, according to the provisions of Article 67 of the Consumer Code (Legislative Decree No. 206 of September 6, 2005), the substantial integrity of the product is an essential condition for the exercise of the right of withdrawal by the Customer. Therefore, if the products returned by the Customer are damaged, incomplete, deteriorated and/or used in a manner inconsistent with normal diligence, such as to compromise their substantial integrity, they will not be refunded.

  1. Compliance – Warranty

With regard to guarantees of conformity of the purchased product, the legal guarantees provided by law are also applicable to the sale of products concluded at a distance through https://brplegno.com regulated by these general conditions.

  1. Complaints – Communications – Information

For any information or complaint, or for any communication regarding the general conditions of mail order sales, orders and/or B.R.P. Legno products, the Customer may contact Customer Service by calling the numbers visible online Monday through Friday on the contact page, or by filling out the form on the “Contact” page https://brplegno.com/pages/contact

It should be noted that, where the Customer decides to use any other channel or form of communication (by way of example: regular mail, calls to a toll telephone number however traceable to Giuseppe Scalia – B.R.P. .) than those described above, it will not be required in any case to reimburse any related expenses incurred by the Customer.

  1. Provisions on privacy and personal data protection

The company Giuseppe Scalia – B.R.P. is the owner of the database that collects the personal data of its Clients. When placing an order from a new Customer through the site https://brplegno.com, the aforementioned database is updated with the data of each new Customer, which will make it possible, later on, to better respond to the Customer’s needs and facilitate the assistance services ensured by the Customer Service and the website https://brplegno.com . The collection and processing of data are carried out in accordance with the provisions contained in D. Lgs. June 30, 2003 no. 196 consolidated (“Privacy Code”). In any case, the Customer has the right to obtain confirmation of the existence of personal data concerning him/her, even if not yet registered, and their communication in an intelligible form, the right to obtain the updating, correction, deletion of his/her personal data, the right to object to the processing of his/her personal data in the cases provided for in Art. 7 of the Privacy Code and other rights established by the Privacy Code by written notice to be sent to brp.legnoservice@gmail.com.

  1. Force majeure

The performance of services by the company Giuseppe Scalia – B.R.P. may be suspended in the event of the occurrence of a fortuitous event or force majeure that prevents or delays its execution. Examples include, but are not limited to, war, riots, insurrections, strikes, and supply problems of the Giuseppe Scalia – B.R.P. company attributable to third-party suppliers. The company Giuseppe Scalia – B.R.P. will inform the Customer of the occurrence of the unforeseeable event or force majeure within 7 (seven) days of its occurrence. In case the suspension of the service should extend for a period longer than 15 days, the Customer will have the opportunity to cancel the order placed and will be refunded the amounts already paid.

  1. Applicable law and jurisdiction

These general conditions of sale are governed by Italian law. In the event of disputes arising from the interpretation, validity and/or execution, of these general conditions of sale, the Customer has the right to protect its interests through a consumer association in the forms of Art. 140 of the Consumer Code, or initiate an out-of-court settlement procedure for the resolution of consumer disputes pursuant to Art. 141 of the Consumer Code. However, it is without prejudice to the Customer’s right to take ordinary action to resolve disputes arising from the interpretation, validity and/or execution, of these conditions.
